1. Acceptance of Terms

By accessing or using the Oddmi Goods website at www.oddmi.com (the "Site") or placing an order through it, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Site.

These Terms apply to all visitors, customers, and anyone who places an order with Oddmi Goods ("Company," "we," "us," or "our").

2. Eligibility

You must be at least 18 years old, or the age of majority in your province/state, to place an order on the Site. By placing an order, you represent that you meet this requirement, or that you are using the Site under the supervision of a parent or guardian who agrees to these Terms on your behalf.

3. Accounts

If you create an account, you must provide accurate, current information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at hello@oddmi.com of any unauthorized use of your account. We may suspend or close accounts that violate these Terms. 

4. Products and Descriptions

We attempt to display product colors, sizes, and details as accurately as possible, but we do not guarantee that your device's display will accurately reflect the actual product. We reserve the right to limit quantities, correct pricing or description errors, and refuse or cancel any order at our discretion, including after an order has been placed. If we cancel an order after payment, you will receive a full refund of the amount charged.

5. Pricing and Payment

Prices are displayed in your local currency (USD or CAD) at checkout based on your shipping destination.

Prices are subject to change without notice, though changes will not affect orders already placed.

Applicable taxes (including GST/HST/PST for Canadian orders and sales tax for US orders) are calculated at checkout based on shipping destination.

Payment is processed through Shopify Payments. By providing payment information, you represent that you are authorized to use that payment method.

We reserve the right to refuse or cancel any order we suspect is fraudulent.

6. Shipping

We ship from Canada to addresses in Canada and the United States. We do not ship to P.O. boxes, freight forwarders, or APO/FPO addresses.

Risk of loss and title for products pass to you upon delivery to the carrier, unless otherwise required by law in your jurisdiction.

Orders shipping from Canada to the United States are shipped on a Delivered Duty Paid (DDP) basis: applicable US customs duties and tariffs are included in the product price. US customers are only charged for shipping as calculated at checkout and should not be charged customs duties on delivery. If a US order is unexpectedly assessed customs charges on delivery, contact us at hello@oddmi.com.

7. Sales Policy

All sales are final. Nothing in this section limits any statutory rights you may have under applicable consumer protection law (see Section 12).

8. User Conduct

You agree not to:

• Use the Site for any unlawful purpose.
• Attempt to gain unauthorized access to the Site or other users' accounts.
• Scrape, harvest, or collect data from the Site using automated means without our written consent.
• Interfere with the operation or security of the Site.
• Submit false information when placing an order (e.g., fraudulent payment details, fake shipping addresses).

We reserve the right to refuse service, cancel orders, or restrict access to the Site for any violation of this section.

9. User-Generated Content

If the Site allows you to submit reviews, comments, or other content ("User Content"): You retain ownership of your User Content but grant Oddmi Goods a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and display it in connection with operating and promoting the Site (e.g., displaying a product review, using a customer photo in marketing). You represent that your User Content is your own, doesn't infringe anyone else's rights, and isn't false, defamatory, or unlawful. We may remove User Content at our discretion, including reviews that violate these Terms.

10. Intellectual Property

All content on the Site — product photography, logos, descriptions, design, and text — is owned by Oddmi Goods or its licensors and protected by copyright and trademark law. You may not copy, reproduce, or use this content commercially without our written permission.

11. Third-Party Links

The Site may link to third-party sites (e.g., payment processors, social media). We are not responsible for the content or practices of third-party sites.

12. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS REQUIRED BY LAW. Nothing in this section, or in this document as a whole, limits any statutory warranty rights you have under British Columbia's Business Practices and Consumer Protection Act, other Canadian provincial consumer protection law, or applicable US state law — those rights apply regardless of this disclaimer.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ODDMI GOODS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. THIS LIMITATION DOES NOT APPLY TO DAMAGES CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR WHERE SUCH LIMITATION IS NOT PERMITTED BY APPLICABLE LAW.

14. Indemnification

You agree to indemnify and hold harmless Oddmi Goods and its officers, employees, and agents from claims arising out of your violation of these Terms or misuse of the Site.

15. Force Majeure

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, labor disputes, carrier delays, customs delays, acts of government, or supply chain disruptions.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute will be resolved in the courts of British Columbia.

17. Changes to These Terms

We may update these Terms at any time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes take effect means you accept the revised Terms.

18. Privacy

Your use of the Site is governed by our [Privacy Policy], which explains how we collect and use your personal information, including for Canadian customers under PIPEDA and, if applicable, US state privacy laws.

19. Entire Agreement; No Waiver

These Terms constitute the entire agreement between you and Oddmi Goods regarding the Site and supersede any prior agreements. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

20. Severability

If any provision of these Terms is unenforceable, the remaining provisions remain in effect.
